1. Personal Information We Collect or Process

  1. Information automatically collected. When you visit our Website, we send one or more "cookies" to your computer or other devices. We may also use cookies in emails that you receive from us. A "cookie" is a small data file that is sent to your web browser and placed on the hard drive of your computer when you access a website. The cookies allow us to track your activities including clicks, purchases, and conversions, devices, etc. We use cookies to improve the quality of our service when you visit our Website and other websites of interest to you.     We operate social media pages on third party networks and have social media icons on our Website. When you visit or link to our social media pages, data is processed both by us and the applicable social media provider. Social media providers are unaffiliated with us, and we are not responsible for the content or privacy practices of social media providers. Social media providers have their own terms of use and privacy policies, and we encourage you to review those policies whenever you visit their websites or interact with their platforms.

  2. Information Voluntarily Provided. We also collect information that you provide to us voluntarily, including in the following situations:

    • When you purchase our products.
    • When you register for inventory updates (to learn when items are back in stock).
    • When you complete a contact form.
    • When you create an account.
    • When you sign up for our newsletter.
    • When you participate in online sweepstakes, contests, and games.

    In connection with the foregoing, the information collected may include name, email address, physical address, phone number, and for purchases, billing information and payment card details.

    If you inquire about a career with us, we or our job hosting provider will collect personal information about you, which may include name, contact information, resume, employment history, and references. We will use the information for recruitment and evaluating candidates.

    From time to time our interactions with you will be conducted over the telephone or video-conference, and such telephone calls and video conferences may be recorded.

  3. Our relationship with Shopify. We use Shopify Network Intelligence to power our online store (the "Store"). Shopify processes your data when you visit and make purchases on the Store. Information you submit to the Store will be transmitted to and shared with Shopify as well as third parties that may be located in countries other than where you reside, in order to provide the Store and improve its services for you. In addition, to help protect, grow, and improve our business, we use certain Shopify enhanced features that incorporate data and information obtained from your interactions with our Store, along with other merchants and with Shopify. To provide these enhanced features, Shopify may make use of personal information collected about your interactions with our Store, along with other merchants, and with Shopify. In these circumstances, Shopify is responsible for the processing of your personal information, including for responding to your requests to exercise your rights over use of your personal information for these purposes.     • Service providers that provide services on our behalf or help us operate the Website, process payments and deliver our products.

While our products are meant to be enjoyed by families and children, the use of our Website, the purchase of the products, and all other aspects of the Website are not intended for the use of children. We do not collect age information and, accordingly, we do not knowingly collect information from users of our Website under the age of 13 and/or their internet usage.

2. How We Use Your Personal Information

We use the personal information we collect as follows:

3. With Whom We Share Personal Information

We may share your personal information with and among our current and future parents, affiliates, subsidiaries, and other companies under common control and ownership.

We share your personal information with third parties who perform services on our behalf, including without limitation our technology providers, payment processors, warehouse & delivery partners, advertising providers, job hosting provider, and professional advisors. We utilize email and a chat feature to provide customer support. Our communications are recorded and used by both us and our email and chat service provider. We may now or in the future provide customer support via chat or email that utilizes artificial intelligence and natural language processing to understand customer questions and automate responses to them, simulating human conversation.

We may disclose information if we have a good faith belief that disclosure is necessary by law or the legal process, to protect and defend our or others' interests or property, or to enforce agreements you enter into with us.

We may share your data with a third party in the event of any reorganization, merger, sale, joint venture, assignment, transfer, liquidation or other disposition of all or any portion of our business, assets or stock with such third party.

We may share information with other third parties with your consent (such as a sponsor of a contest).

We may share aggregated and de-identified information with third parties for analytical, research or other similar purposes.

4. Mobile Messaging

  1. Transactional Text Messages. We, Shopify and/or warehouse & delivery partners may use your mobile number to send you text messages to provide status updates on your orders and shipping information. By default, Shopify will send transactional communications via email if you provide an email address. However, if you do not provide an email address but do provide a mobile number, Shopify will use your mobile number to communicate by text message. Participation in mobile messaging is optional and not a condition of purchase. By providing your mobile number, you are consenting to receive mobile messages at the phone number you provide.

  2. Marketing Text Messaging (Opt-in Only). If you choose to opt-in to our mobile marketing program, we may send you text messages regarding promotions, sales, and other marketing offers. This is a strictly opt-in service. Participation in mobile messaging is optional and not a condition of purchase. You will only receive marketing messages if you have provided your affirmative consent (e.g., by checking a box at checkout or signing up via a dedicated form). By participating in mobile marketing, you agree to receive autodialed or prerecorded marketing mobile messages at the phone number associated with your opt-in. While you consent to receive messages sent using an autodialer, the foregoing shall not be interpreted to suggest or imply that any or all of our marketing messages are sent using an automatic telephone dialing system ("ATDS" or "autodialer"). Message and data rates may apply. You may opt out of marketing messages at any time by replying "STOP" to any message received. After you send the message "STOP" to us, we may send you a message to confirm that you have been unsubscribed from marketing messages.

  3. Mobile messaging requires sharing information with platform providers, phone companies, and other third-party service providers who assist us in the delivery of mobile messages. If you have provided a mobile number, we will share that with our warehouse & delivery partners to assist with delivery; accordingly, warehouse & delivery partners may contact you via mobile messaging in accordance with their own policies.

As with all information we collect, we reserve the right at all times, to the extent permitted by law, to disclose any information as necessary to satisfy any law, regulation or governmental request, to avoid liability, or to protect our rights or property.

5. Storage and Protection of Your Personal Information

We retain the personal information we collect for so long as reasonably necessary to fulfill the purposes for which the information was collected and to perform our contractual and legal obligations. We will retain personal information required to comply with privacy requests, to manage active accounts, to address warranty claims, as required by law, in order to resolve disputes, or to enforce our agreements. We may also retain copies of your personal information for disaster recovery purposes, to prevent fraud or future abuse, or for our legitimate business purposes.

Notwithstanding the generality of the foregoing, we store email addresses for marketing purposes until the user requests to be unsubscribed.

We take reasonable administrative, physical and technical precautions to protect your personal information and communications between us. This includes, when required or as we deem appropriate and feasible under the circumstances, encryption and written commitments from third parties that may have access to your information that they will protect the information with reasonable safeguards.

We do not store payment card information; rather we utilize the Shopify platform and payment processors and store only an electronic receipt that sets forth confirming payment details, such as purchase date, the expiration date of the payment card and the payment ID, but not complete payment card information.

No Internet or e-mail transmission is ever fully secure or error free. We therefore cannot guarantee absolute security of your information, and we are not responsible for processes and networks that we do not control. Users assume the risk of security breaches and the consequences resulting from them. Please be careful in deciding what information you send to us via email or over the Internet.

6. Your Rights, Choices and Disclosures

We are committed to facilitating the exercise of your rights granted by the laws of your jurisdiction and to which we are subject, which may include the right to request the correction, modification or deletion of your personal information and the right to opt out of the sale or sharing of your personal information (as applicable). Some non-marketing communications may not be subject to a general opt-out, such as communications about your purchases, disclosures to comply with legal requirements, and other support-related information.
